1. Agreement to Terms
By creating an account, initiating a 45-day free trial, or subscribing to the Empvia HR platform ("Service"), your organization ("Customer") agrees to be legally bound by these Terms & Conditions ("Terms").
The Service is developed, hosted, and operated by Sidhiksha Solutions ("Company", "we", "us"). If you are accepting on behalf of an entity, you represent and warrant that you hold legal authority to bind that entity.
2. Subscription & 45-Day Free Trial
We offer newly registered enterprises a comprehensive 45-day evaluation period at zero cost without mandatory upfront payment credentials:
- During the trial, the Customer enjoys full platform functionality across attendance, shifts, employee management, and leave workflows.
- At trial expiration, Customer may select an active paid tier (Starter, Professional, Business, or Enterprise) to retain ongoing access.
- If no tier is selected, account access becomes read-only and is subject to automated de-provisioning after a standard grace period.
3. Acceptable Use & Account Responsibilities
The Customer is solely responsible for:
- Maintaining the confidentiality of administrative credentials and employee login tokens.
- Ensuring that all employee records, attendance punches, and salary calculations comply with local labor regulations.
- Refraining from reverse-engineering, decompiling, or attempting unauthorized penetration of the platform infrastructure.
- Ensuring no malicious code, unauthorized automated scripts, or infringing content is transmitted through the system.
4. Service Availability & Infrastructure Reliability
We endeavor to maintain high service availability and reliable operation for production services, utilizing resilient cloud infrastructure and automated monitoring. Scheduled maintenance windows are notified in advance. Critical security patches and database upgrades are executed with minimal service disruption.
5. Intellectual Property Rights
All intellectual property rights in the software, algorithms, designs, logos, and platform documentation remain the exclusive property of Sidhiksha Solutions.
The Customer retains complete and exclusive ownership of all organizational data, employee files, attendance logs, and financial records uploaded to or generated by the Service.
6. Limitation of Liability
To the maximum extent permitted by applicable law, neither party shall be liable for indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Service.
7. Termination & Cancellation
Customers may cancel their subscription at any time via the billing portal. Upon termination, Customer data will be exportable in standard formats (CSV, JSON, PDF) for up to 30 days prior to permanent secure purging.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
